Art. 1 – GENERAL CONDITIONS OF SALE

These General Conditions of Sale govern the methods of sale of goods and services (hereinafter also referred to as products) marketed by Corte Canella SS and regulate the sales contracts of products stipulated within this website between Corte Canella SS, registered office in Via Canella 14, 37031 Illasi – VERONA -, CF and VAT number 03690990233 and the buyer (hereinafter also referred to as the Customer).

These general conditions may be updated or modified at any time by Corte Canella SS, which will provide notice according to times and methods that will be defined unilaterally by Corte Canella SS itself at its sole discretion. The consumer is required to read and accept these conditions and any communications in full before making any purchase.

These premises constitute an integral and substantial part of each product sales contract stipulated on the website www.cortecanella.it

Art. 2 – OBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION

By “online” sales contract we mean the distance contract or the legal transaction having as its object movable goods and/or services stipulated between the supplier Corte Canella SS and the consumer (hereinafter the “Customer”) within the scope of a distance selling system organised by the supplier who, for such contract, uses in a prevalent but not exclusive form, the distance communication technology called “internet”.

All contracts, therefore, will be concluded, unless otherwise agreed, directly through access by the consumer Customer (adults only) to the corresponding website, where, following the indicated procedures, he will conclude the contract for the purchase of the goods. The sale will be concluded in the production premises of the company, with the sending, from the same, of the products subject to the contract and related tax documents.

It is at the discretion of the Court Canella SS to accept an order and the customer is not entitled to any compensation for damages caused by failure to accept the order.

Art. 3 PURCHASE METHODS

The purchase of products is made by the Customer at the price indicated at the time of sending the order confirmation. Before confirming the purchase, the Customer will be given a summary of the unit cost of each product chosen, the total cost in the case of purchasing multiple products and the related shipping costs. By confirming the purchase, upon completion of the transaction, the Customer will receive an email containing the estimated shipping date, the total amount of their order and the details of the order. In the event of temporary unavailability of the products ordered, the Customer will be notified promptly and will have the right to choose whether to complete the purchase or to renounce it.

Payment for the products purchased and the related shipping costs must be made by the Customer using the payment instruments indicated in the following article 5. Corte Canella SS reserves the right to confirm or modify the prices of products not available in stock at the time of the Order Confirmation based on the current price lists, the publication of which cancels and completely replaces the previous price lists. Any additional costs, including shipping costs, will be indicated before the purchase confirmation.

At his discretion, the customer may, when entering data, decide to create an account on our site, with username/email address and password: by doing so, he will not have to re-enter all the data in the event of other purchases and will be able to consult his orders at any time.

Art. 4 AVAILABILITY AND NATURE OF PRODUCTS

Although we do our best to reserve products for the e-shop and update the stock situation in real time, we may not be able to supply these products in extraordinary cases or for reasons beyond our control. In this case, the Customer will be contacted and notified as soon as possible, with a possible proposal (which he can freely accept or not) of alternative products as a replacement. In the event that the customer decides not to accept our proposals, the amount of the order relating to the products that we are unable to supply will be refunded by bank transfer (the details of which will be communicated by the customer), with the issuance of a reversal document.

We remind you that the product selected and ordered on the site www.cortecanella.it is a photographic reproduction as close as possible to the real product, however it may have slight differences compared to it. In any case, we remind you of the existence of the legal guarantee of conformity for the goods.

Art. 5 DELIVERY METHODS

The delivery of the products will take place during working days. The courier used may vary.

Indicatively, without this implying any constraint and subject to the availability of the products on the market, in addition to any causes of force majeure, the goods will be delivered to the courier within 72 hours, from the first working day following the date of receipt of payment and from that moment Corte Canella SS will no longer be responsible for any damage due to transport, for this reason it is recommended to make shipments using insured methods (see Art.6).

In case of absence, Corte Canella SS the courier's conditions must be followed to schedule a redelivery or storage hold.

Deliveries are intended to be made on the ground floor.

The customer must ensure that the number of packages delivered corresponds to that indicated on the shipping label attached to the package.

Before accepting delivery, the Customer is required to verify that the package is intact, not damaged or wet. Any damage or discrepancy in the number of packages or indications must be immediately contested to the courier who makes the delivery, by writing "withdrawal with reservation" on the appropriate document.

In any case, the customer is not required to have the courier carry out checks on the purchased item. Therefore, he/she will not be able to open the package to check its condition.

Art. 6 SHIPPING COSTS

Any shipping costs will be communicated before the order is confirmed.

Art. 7 RIGHT OF WITHDRAWAL AND RETURN OF GOODS

Pursuant to articles 64 et seq. of Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity, or does not make the purchase by indicating a VAT number in the order form), he/she has the right to withdraw from the purchase contract within 14 calendar days from the date of receipt of the goods, for any reason without the need to provide explanations. The customer has the right to a refund for the purchase price excluding additional costs (shipping costs or bank charges). To exercise this right, the customer must inform Corte Canella SS that he/she wishes to avail himself/herself of the right of withdrawal by sending a request to the email address info@cortecanella.it

The right of withdrawal is however subject to the following mandatory conditions:

• The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g. accessories, parts, etc.);
• The right does not apply to sealed products once opened;
• The purchased item must be intact and returned in its original packaging complete in all its parts;
• Shipping costs for returning the goods are the responsibility of the Customer.
• The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer;
• In the event of damage to the goods during transport, Corte Canella SS will inform the Customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier and obtain reimbursement of the value of the goods (if insured); in this eventuality, the product will be made available to the Customer for its return, simultaneously cancelling the request for withdrawal;
• Corte Canella SS is not responsible in any way for damage or theft/loss of goods returned with uninsured shipments.
• The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Corte Canella SS ascertains:
  • The absence of the external packaging and/or the original internal packaging;
  • The absence of integral elements of the product or anomalies in the product itself;
  • Damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Corte Canella SS will return the purchased goods to the sender, charging the latter the shipping costs (the goods will be sent once the balance of the transport costs has been received from the customer).

Art. 8 WARRANTIES

All products marketed by Corte Canella SS are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree no. 24/02. To benefit from warranty assistance, the Customer must keep the document that he/she will receive together with the purchased goods.

The manufacturer's conventional warranty is provided in accordance with the procedures illustrated in the documentation included in the product packaging. If, following intervention by an Authorized Service Center, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and repair requested by the Authorized Service, as well as transport costs, if incurred by Corte Canella SS. The 24-month warranty pursuant to Legislative Decree no. 24/02 applies to the product that presents a lack of conformity, provided that the same is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty, in compliance with Legislative Decree no. 24/92, is reserved only for the private Consumer (a natural person who purchases the goods for purposes not related to his/her professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, Corte Canella SS will, at no cost to the Customer, restore the conformity of the product through repair/replacement or price reduction, up to the termination of the contract. If, following intervention by an Authorized Assistance Center, a lack of conformity does not result in a lack of conformity pursuant to Legislative Decree no. 24/02, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs if incurred by Corte Canella SS

Replacements in the event of a product not working at first start-up, except for the existence of the conditions for the application of Legislative Decree no. 24/02, will be carried out only if expressly provided for by the manufacturer. The times for replacement or possible repair of the product depend exclusively on those indicated by the manufacturer. The Customer may therefore interface directly with the assistance centres or give Corte Canella SS a mandate to handle the repair. Transport costs will be borne by Corte Canella SS

In the event that, for any reason, Corte Canella SS is unable to replace a product under warranty (repaired or replaced), it may proceed, with the prior consent of the Customer, to replace the product itself (if still in the price list) or with another of equal characteristics and value or, finally, to issue a discount voucher of the same amount to be spent on another product, valid for 6 months from the time of issue.

No damages can be requested from Corte Canella SS for any delays in carrying out repairs or replacements of products under warranty.

Art. 9 REFUNDS

All refunds to Customers following defective, broken or non-compliant material sent to that ordered will be made, after completing the relevant form to be sent to info@cortecanella.it

Art. 10 PRIVACY

The personal data requested during the order process are collected by Corte Canella SS and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will not be transferred to third parties under any circumstances and for any reason. Corte Canella SS guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree No. 196 of 30.06.03.

The data controller is Corte Canella SS Via Canella 14, 37031 Illasi – VERONA – ITALY, in the person who has the legal representation. The customer, at any time, has the right to revoke consent to the processing of personal data by sending a written communication to the registered office of Corte Canella SS. The customer, who declares to have received the information pursuant to art. 13 and on the rights to which he is entitled, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access his data according to the methods provided therein.

Marketing communications will be sent only with the explicit consent of the Customer given together with the authorization for processing and sending in the online registration form.

Art. 11 – JURISDICTION AND COMPETENT COURT

The sales contract between the Customer and Corte Canella SS is deemed to be concluded in Verona and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Verona.

Art. 12 – RESPONSIBILITY

Corte Canella SS assumes no responsibility for any disruptions attributable to force majeure and/or unforeseeable circumstances such as accidents, thefts and/or robberies of the delivery person, fires, explosions, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract in the times and ways agreed. Likewise, Corte Canella SS is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards and other means of payment, when paying for the products purchased. In fact, Corte Canella SS, at no time during the purchase procedure is able to know the buyer's credit card number which, by opening a protected connection, is transmitted directly to the Banking Institute managing the service;

Art. 13 PURCHASER'S OBLIGATIONS

The customer undertakes and is obliged, once the online purchase procedure has been concluded, to print and keep these general conditions, which, moreover, he/she will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased contained in the order receipt email.

It is strictly forbidden to enter false and/or invented data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and email must be exclusively your real personal data and not those of third parties, or fictitious. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. Corte Canella SS reserves the right to report any violation and abuse, in the interest and for the protection of all consumers.

Art. 14 PAYMENT METHODS

For online purchases Corte Canella SS accepts the following payment methods:

Art. 14.1 – CREDIT CARD

Payment is made by credit card. The recognized cards are those belonging to one of the circuits recognized and accepted by the Stripe platform.

Art. 14.2 – BANK TRANSFER

Payment must be made offline via bank transfer. Shipping times will be recalculated based on the time of credit.

Art. 15 MODIFICATIONS TO THE CONDITIONS

The conditions contained in this document may be modified by Corte Canella SS without prior notice and will be valid from the date of publication on the website www.cortecanella.it
